Terms of Service

1. Agreement

These Terms govern use of khumalomaths.co.za and purchases from Khumalo Maths Academy. By booking a lesson, purchasing a product, creating an order or using the website, you agree to these Terms and the policies linked from them. If the customer or learner is under 18, a parent or legal guardian must accept the Terms and is responsible for the booking and payment.

2. About Khumalo Maths Academy

Khumalo Maths Academy is a trading name operated by Nkosinathi Thimothy Khumalo as an individual/sole proprietor in Pretoria, Gauteng, South Africa. We provide CAPS-aligned mathematics tutoring and digital educational resources. We are not a registered school, examination authority or provider of formal qualifications, and we are not affiliated with or endorsed by the Department of Basic Education unless expressly stated.

3. Services and product descriptions

We aim to describe lessons and digital resources accurately. Images, previews and page counts are illustrative only where expressly indicated. We may correct obvious errors before accepting an order. Material changes to a confirmed order will be communicated and handled fairly.

4. Orders, prices and payment

  • Prices are displayed in South African rand unless stated otherwise.
  • Payment must be completed through the payment method made available at checkout.
  • An order is accepted when payment is confirmed and we make the service or download available, unless we notify you that the order cannot be fulfilled.
  • The customer is responsible for providing accurate contact and billing information.
  • Promotions and discount codes may have separate conditions and expiry dates.

5. Lessons

Learners must attend on time, participate respectfully and have the required device, connectivity and materials. The scheduled end time is not normally extended for late arrival or customer-side technical problems. Cancellation and rescheduling are governed by the Cancellation Policy.

6. Digital delivery

Digital products are delivered according to the Digital Product Delivery Policy. The customer must provide a working email address, maintain compatible software and keep order links and files secure.

Licence, acceptable use and intellectual property

7. Personal-use licence

Unless a different licence is stated at purchase, a paid digital product is licensed to one purchasing household, learner or educator for personal educational use. The licence is limited, non-exclusive, non-transferable and does not transfer ownership of intellectual-property rights.

You may download and print a reasonable number of copies for the licensed user's own study or teaching preparation. You may not, without written permission:

  • share, email, upload, resell, sublicense or distribute the files to another person or group;
  • post the material on a public website, social-media group, shared drive or learning-management system;
  • remove ownership, source, copyright or licence notices;
  • use the material to create a competing product or paid course; or
  • use automated tools to scrape, reproduce or systematically extract the content.

8. Intellectual property and source material

Khumalo Maths Academy owns or licenses the website design, branding, original questions, compilation, typesetting, explanations, worked solutions and other Academy-created content. Official examination material and other third-party content remain subject to the rights of their respective issuing authorities or owners. Where source questions are used, we aim to identify the source. No third-party reference implies endorsement or affiliation.

9. Acceptable use

You may not use the website or services unlawfully, impersonate another person, interfere with security, submit malicious code, harass a learner or tutor, misuse payment systems, or infringe another person's rights. We may suspend access where reasonably necessary to protect users, content, payments or systems.

10. Educational disclaimer

The resources and lessons support learning but do not guarantee marks, promotion, examination results, admission or any other outcome. Learners remain responsible for study, attendance and following official school and examination instructions. Information may contain inadvertent errors; please report them so that we can investigate and correct them.

11. Third-party services and links

Payment, messaging, hosting and other third-party services operate under their own terms and privacy notices. We are not responsible for an independent third party's service except to the extent that applicable law makes us responsible.

Liability, complaints and general terms

12. Availability and technical interruptions

We aim to keep the website and services available but do not promise uninterrupted access. Maintenance, connectivity failures, platform outages or events beyond reasonable control may affect delivery. We will take reasonable steps to restore service or provide an appropriate alternative.

13. Liability

To the maximum extent permitted by law, Khumalo Maths Academy is not liable for indirect or consequential loss, loss caused by misuse of the materials, or failures outside our reasonable control. Any limitation applies only where lawful and does not exclude liability for gross negligence, wilful misconduct, fraud, death or personal injury caused by an act for which liability cannot be excluded, or any non-excludable consumer right.

14. Refunds and cancellations

The Refund Policy and Cancellation Policy form part of these Terms. If a mandatory consumer right gives you a greater remedy, that right prevails.

15. Complaints and disputes

Please contact us with your order reference and a clear description of the issue. We will try to resolve complaints fairly and within a reasonable time. Nothing in these Terms prevents a customer from approaching a regulator, ombud, court or other forum where legally entitled to do so.

16. Changes to these Terms

We may update these Terms prospectively. Changes do not remove rights already accrued under a completed transaction. The current version will show its effective and last-updated dates.

17. Severability and no waiver

If a clause is invalid or unenforceable, it will be read down or severed to the minimum extent necessary, and the remaining clauses will continue. A delay in enforcing a right is not a waiver of that right.

18. Governing law

These Terms are governed by the laws of the Republic of South Africa, subject to any mandatory consumer-law forum or protection that applies.
